Welcome to GetSolar Sdn. Bhd. (“GetSolar”, “we”, “our”, “us”) website located at https://getsolar.ai/ and any related subdomains (collectively, the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and the services provided through the Site (“Services”). By accessing or using the Site or Services, you agree to be bound by these Terms.

GetSolar provides rooftop solar rent-to-own services, as well as rooftop solar estimation and an online calculator for homes and commercial properties in Southeast Asia through this Site.

4. User Obligations

When using our Site and Services, you agree to:

• Keep your username and password required to access the Services secure and confidential at all times.
• Not attempt to undermine the security or integrity of our computing systems or networks where the Services are hosted.
• Not attempt to copy, reproduce, reverse engineer, or decompile any computer program, design, functionality, or any other component of the Services.
• Not post, transmit, distribute, upload, or otherwise disseminate through the Service any private or confidential information of any person or entity, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers, credit card numbers, and any trade secrets or information for which you have any obligation of confidentiality or material that impersonates any person or entity, or misrepresents your affiliation with the Service or with any other person or entity.

Age Restriction: You must be at least 18 years of age to use this Site and Services.

5. Intellectual Property

GetSolar, its affiliates, suppliers, and licensors own all right, title, and interest, including all intellectual property rights, in and to the Service. Except for the rights expressly granted in these Terms, no other rights are granted, either express or implied, to you. You may not use any of our intellectual property without our express written permission.

6. User-Generated Content

At this time, users are not permitted to post content such as reviews or comments on our Site.

7. Purchases And Payments

Terms surrounding the GetSolar Rent-to-own solar offers are governed by a separate Rent-to-own agreement provided to customers. All purchases and transactions on the Site are subject to these specific terms.

8. Disclaimer Of Warranties

Your use of the Site and Services, including any content accessible through the Site, is at your sole risk. The Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, GetSolar disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Services will be uninterrupted, timely, secure, or error-free, or that any content will be accurate or reliable.

No advice or information, whether oral or written, obtained by you from GetSolar or through the Site will create any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Limitation Of Liability

To the fullest extent permitted by applicable law, GetSolar, its affiliates, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Site or Services. This limitation applies even if GetSolar has been advised of the possibility of such damages.

In jurisdictions that do not allow the limitation or exclusion of liability for incidental or consequential damages, our liability is limited to the maximum extent permitted by law. In no event will GetSolar’s total liability to you for all claims arising under these Terms exceed the amount of one hundred Malaysian Ringgit (MYR 100). 

10. International Data Transfers

By using our Site and Services, you acknowledge and agree that your personal data may be transferred to, stored in, and processed at our headquarters in Singapore, as well as other countries where we, our affiliates, or third-party service providers maintain facilities. These countries may have data protection laws that are different from those in Malaysia.

We take appropriate measures to ensure that your personal data remains protected in accordance with these Terms and the Malaysian Personal Data Protection Act 2010 (PDPA). These measures may include:

Ensuring that the destination country offers an adequate level of data protection comparable to that under Malaysian law; or

Implementing legally recognized safeguards, such as binding corporate rules, standard contractual clauses, or equivalent mechanisms.

Where such safeguards are not available, we will obtain your explicit consent to the transfer, unless otherwise permitted by law.

11. Termination

Your online account remains in effect unless you cancel it or unless GetSolar terminates your account as provided by these Terms. To terminate your online account, please email GetSolar Customer Success at support@getsolar.ai. You may not terminate your written Rent-to-own Agreement by emailing GetSolar. Notwithstanding any provision of these Terms, we reserve the right, without notice and in our sole discretion, to terminate your account and to block, restrict, and prevent your future access to, and use of, the Site and Services.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts of Malaysia.

13. Changes to the Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site and Services following the posting of revised Terms means that you accept and agree to the changes. We recommend that you review these Terms periodically.
